Farrar Focus LLP End-User License Agreement
Besides describing our intention to stay in business so we can crank out more useful products such as this one, basically this license says that in turn for not pirating the software we want you, your family, or your business to be able to do just about anything you want with it.
LICENSE
By purchasing and/or using the software you, the customer and your License Grantees (see Section 1.), are confirming your acceptance of the software and agreeing to become bound to the terms of this Agreement.
1. LICENSE GRANTS. This license grants the following usage rights to (herein refered to as License Grantees) either, if a personal purchase, you and your immediate family, or if a business purchase, the business and all of its employees, the right to use and install the software on any number of computers, and modify the software. You may NOT distribute copies of the software to person(s) not granted usage rights as per this agreement, transfer ownership of the software, rent or lease the software, reverse engineer the software, or sell derivative works based upon the software.
2. TERMINATION. If you breach this Agreement, you and your License Grantees rights to use the product are terminated immediately without notice, and you must destroy all copies of the product.
3. DISCLAIMER OF WARRANTY. The product is provided "as is" with all faults. To the extent permitted by law, Farrar Focus LLP hereby disclaim all warranties, whether expressed or implied, including, and without limitation to, warranties that the product is free of defects, merchantable, fit for a perticular purpose and non-infringing. You and your License Grantees bear the entire risk as to usage, quality, and performance of the product. Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
4. LIMITATIONS OF LIABILITY. Except as required by law, Farrar Focus LLP will not be liable for any indirect, incidental, punitive, special, exemplary, or consequential damages arising out of or in any way relating to this agreement or the use or inability to use the product, including but not limited to damages for the loss of business, loss of profits, business interruption, loss of goodwill, loss of data, and computer malfunction or failure, even if advised of the possibility of such damages and regardless of the theory, contract, or tort, upon which such claim is based. Farrar Focus LLP's collective liability under this agreement will not exceed the fees paid by you under this license. Some jurisdictions do not allow the limitation or exclusion of incidental, special, or consequential damages, so this exclusion and limitation may not apply to you.
5. MISCELLANEOUS. This agreement may not be modified.
